Mediation is a private and confidential process in which a qualified mediator assists parties to try and resolve their disputes. It is cost effective and highly successful with a settlement rate exceeding 80%.

It is estimated that disputes cost British Business billions of pounds every year. Indeed in its Fourth Mediation Audit published in May 2010 CEDR (the Centre for Effective Dispute Resolution) estimated that commercial mediation alone will save the British Economy £1.4 billion annually in wasted management time, damaged relationships, lost productivity and costs.

The Government itself is now committed to engaging in dispute resolution and in its Dispute Resolution Commitment published in May 2011 stated that mediation "should be seen as the preferred dispute resolution route when conventional negotiation has failed". In its Annual Pledge Report published in March 2010 the Government estimated that it had saved costs of £90.2million by engaging in dispute resolution the previous year and currently estimates that it has saved £360 million in the past decade.

The Court of Appeal in the case of Rolf v De Guerin (2011) EWCA Civ 78 has recently reconfirmed the previous Court of Appeal decision of Dunnett v Railtrack Plc (2002) EWCA Civ 303 and made it clear that there are likely to be significant cost consequences for parties who fail to engage in mediation. Indeed in that case the Defendant lost the whole of his original costs award by failing to participate in mediation and dispute resolution.
